46-year-old woman survives mesothelioma–now pregnant with first child

July 25th, 2008 Mike Evans

Mesothelioma hasn’t taken the life of a 46-year-old Australian woman, as her doctors predicted. According to a July 26 article in The Age, Anita Steiner was diagnosed with mesothelioma 14 months ago. Doctors removed Steiner’s right lung and put her on palliative chemotherapy to buy her some time. They told her she might have as long as 12 months to live. But, to their surprise, Steiner’s mesothelioma went into remission. Doctors told Steiner she was clear of the cancer at the beginning of 2008. Now Steiner, who was trying to become pregnant before she developed mesothelioma, has learned that she is 5 months pregnant with her first child. She says she is aware that the cancer may return, but is focusing on the future with her new child.

Steiner is using the publicity surrounding her case to try to educate people about the dangers of asbestos. Steiner’s mesothelioma has been traced to her exposure to asbestos at age six, when her father pulled down a workshop in their backyard. She is part of what some experts refer to as the “third wave” of asbestos victims, which includes children who were exposed to asbestos in and around their homes 30 to 40 years ago.

In an effort to raise awareness and support for sufferers, Ms Steiner has set up a chat site through the Asbestos Diseases Society of Victoria.

Asbestos causes school woes in Tempe, Arizona and Albany, New York

July 24th, 2008 Mike Evans

According to an article from Tempe, Arizona, the Tempe Union High School District will retest all of its campuses for asbestos because administrators are unable to find documents outlining the removal of asbestos 15 years ago. In May 2008, asbestos was found in blocks in an outside canopy structure at Corona del Sol High School in Tempe, according to a school administrator. Parents noticed dumpsters and workers wearing hazardous-material gear outside the school, according to parent DeeAnne Clowes. Clowes said a school adminstrator told her a couple of “hot spots” were found.

Meanwhile, an Albany, New York article reports that the Thomas O’Brien Academy of Science and Technology, a magnet elementary school in the Albany City School District, will be closed for the upcoming school year because of asbestos problems. When the school year closed in June, 2008, work crews began window replacement and a small amount of asbestos remediation. “In doing this and other work, they found there were places that we believed to be remediated in late 1980s that were not remediated for asbestos,” said Ron Lesko, a spokesperson for the school district.

Lesko said air samples were taken at the school, but none tested positive for asbestos. “There is a perception of asbestos and health risks. We don’t want to take any possibility of putting anyone at risk and want to protect students and staff,” said Lesko. “We will remediate the building properly and have work complete for 2009-2010.”

By law, all schools are required to adhere to guidelines set by the Asbestos Hazard Emergency Response Act (AHERA). The provision passed by Congress in 1986 requires local education agencies to inspect their schools for asbestos-containing building material and prepare management plans to prevent or reduce asbestos hazards.

The law requires an original inspection and follow-up inspections of asbestos-containing material every three years. An asbestos management plan must be maintained and kept at the school as well.

Asbestos has been known to cause malignant mesothelioma, lung cancer, other types of aasbestos cancer, and asbestosis.

Any person who has suffers from a disease caused by asbestos, or who has a family member with asbestos-caused disease, is invited to obtain more information at the Mesothelioma Attorney Alliance’s website. New clinical trial for patients with pleural mesothelioma

June 29th, 2008 Mike Evans

The Mesothelioma Center at NewYork-Presbyterian Hospital and Columbia University Medical Center is now recruiting patients for a clinical research study of a new targeted radiation and chemotherapy protocol for pleural mesothelioma. The standard treatment at the present time is removal of the patient’s lung. Current surgical and chemotherapy treatments of patients with malignant pleural mesothelioma have not significantly prolonged the lives of patients with the disease.

“In this study, we will investigate whether a combination of chemotherapy and radiation targeted directly at the lung’s lining can improve outcomes while avoiding surgery,” says Dr. Robert Taub, the study’s principal investigator, and director of the Mesothelioma Center. “In addition, this approach has shown to have minimal toxic side effects compared to systemic chemotherapy.”

“This trial is also significant because our center is the only one nationwide that is offering this experimental therapy to treat pleural mesothelioma,” added Dr. Taub. “We are very focused on offering these patients the best treatment that medical technology can offer while simultaneously working to preserve quality of life.”

Researchers also anticipate that the radiation therapy will kill the cancer cells on surface of the lung while sparing other parts of the lung and surrounding vital tissues.

Florida asbestos lawsuits given new life by Florida appellate court

June 3rd, 2008 Mike Evans

Corporate defendants have tried many tactics to avoid paying compensation to people suffering from asbestosis, malignant mesothelioma, and other types of asbestos cancer. One ploy asbestos defendants have tried in recent years is to ask Congress and state legislatures to take away the right of injured citizens to file lawsuits.

The asbestos industry tried this tactic in Florida, where the legislature passed a law that retroactively required plaintiffs to show higher levels of injuries in order to recover money in asbestos lawsuits. The law had the potential to lead to the dismissal of thousands of lawsuits seeking to hold companies liable for asbestos-caused diseases. But, in a victory for ordinary people, the Florida 4th District Court of Appeal on  May 28, 2008 unanimously ruled that the law was unconstitutional. The was a victory for fairness, and for thousands of people in Florida who have been injured by exposure to asbestos.

Here is a link to the opinion of the Court.

Spaniards can sue in New Jersey for asbestos exposure on U.S. Navy ships

May 28th, 2008 Mike Evans

An Insurance Journal article reports that a group of Spanish workers injured by asbestos-containing insulation while working on U.S. Navy ships docked in Spain can sue the manufacturer of the insulation in New Jersey — where the products were produced — according to the ruling of a three-judge panel of the New Jersey Superior Court. The workers are seeking recovery for asbestosis they say was caused by their exposure to asbestos on the ships. The court ruled that U.S. Navy ships are considered U.S. territory wherever they are docked; therefore, claims for asbestos exposure on a Navy ship should be heard in the U.S., according to the court.

Chicago, Illinois beach contaminated with asbestos

May 28th, 2008 Mike Evans

A May 27, 2008 Environment News Service article reports that asbestos fibers from the Johns-Manville Asbestos Superfund site have been washed into Lake Michigan, contaminating beaches as far south as Chicago’s Oak Street beach. Asbestos is known to cause malignant mesothelioma and other types of cancer and disease. There is no known safe level of exposure to asbestos. The Illinois Dunesland Protection Society says, if you cannot avoid Lake Michigan beaches, there are some tips you can follow to try to minimize breathing asbestos:

  • Avoid Eating and Drinking at the Beach! Asbestos and amphibole fibers can contaminate your hands, food, and containers. Eat in picnic areas away from the beach.
  • Avoid Disturbing the Sand! Microscopic asbestos can be released from the sand when agitated. The federal Centers for Disease Control found that amphibole asbestos fibers can be released from wet sand and become airborne.
  • Shower Off and Clean Belongings Prior to Leaving the Beach! The deadly amphibole asbestos fibers can be found wherever beach sand can go. Wash your whole body including hair, ears, and under fingernails. Pets should also be washed down prior to leaving the lakefront and beaches.
  • Carefully Clean or Isolate Items Used at the Beach! The U.S. Environmental Protection Agency warns, “Don’t track material that could contain asbestos through the house.”
  • Take care when shaking out towels and blankets that may have come into contact with sand. Remove all beach clothing before entering your car or home. Launder clothing, blankets, and towels separately. Store shoes and hard to clean items outside.
  • Avoid Certain Cleaning Methods! Do not dust, sweep, or vacuum debris that may contain asbestos. According to the EPA, “These steps will disturb tiny asbestos fibers and may release them into the air.” The use of High Efficiency Particulate Air, HEPA, filtered vacuums is recommended for cleaning up toxic dust and fibers.

These tips were compiled by Jeffery Camplin, an Illinois licensed asbestos professional and nationally recognized asbestos safety risk expert.

First asbestos, now carbon nanotubes can cause mesothelioma

May 22nd, 2008 Mike Evans

A study by the Project on Emerging Nanotechnologies found that some carbon nanotubes, which are used like building blocks in nanotechnology, can cause cancer, just like asbestos. According to a Computerworld article about the study, the nanotubes actually look like asbestos fibers, behave like asbestos fibers, and can cause cancer of the lung lining. The cancer can take 30 to 40 years to appear following exposure.

It’s a good thing the study was done this soon. We can hope that it will allow us to avoid another tragedy such as the one involving wide-spread exposure to asbestos and the resulting cases of mesothelioma and other types of asbestos-caused disease and cancer.

EPA honors man for work protecting kids from asbestos

May 13th, 2008 Mike Evans

Asbestos in art clay for children? Apparently somebody, somewhere, thought it sounded like a good idea.  Fortunately there are people such as Ron Skomro who don’t think that’s such a good idea. According to a Connecticut Business News Journal article, the Environmental Protection Agency (EPA) recently honored Skomro for his efforts to protect children from being exposed to asbestos in art clay. Skomro, supervisor of the Connecticut Department of Public Health’s Asbestos Program, worked with suppliers to stop the sale of art clay in the state that contains asbestos-containing talc.

Skomro also got the Art & Creative Materials Institute to require member manufacturers to reformulate their products to remove asbestos, which has been linked to diseases like asbestosis, lung cancer and mesothelioma.

We at the Mesothelioma Attorney Alliance say kudos to Mr. Skomro.
